2019 Petro-Pass "Hat's Off to Great Drivers" contest rules and regulations (The "Rules")
1. How to participate
The sponsor of this Contest is Suncor Energy Products Partnership (hereinafter called “Suncor” or “Sponsor”).
No purchase necessary.
1.1 Eligibility: The Petro-Pass™ Hats off to Great Drivers Contest (the “Contest”) is open to all residents of Canada who, as of May 27, 2019 (a) are employees orindependent contractors who drive a delivery vehicle for or on behalf of any 708 account SuperPass™ Cardholders, BVD Petroleum Inc. cardholders, or Petro-Canada™ Wholesale Marketer FuelCardholders (“Cardholder”); (b) have reached the age of majority in their province of residence; and (c) are in good standing with their employer (the driver of a vehicle, who canparticipate in the Contest, is referred to as an “Eligible Driver”). The following are not eligible to be qualified as Eligible Drivers: (a) employees and retirees of Suncor; (b) Suncor’saffiliates, franchisees, agents, associates, dealers, representatives, advertising and promotional agencies; and (c) members of the immediate family of those persons listed in (a) or (b),or any person with whom they are domiciled.
1.2 Contest Period: Between 12:00 a.m. Eastern Time on May 28, 2019 and 11:59 p.m. Eastern Time on July 15, 2019 (the “Contest Period”), Cardholders, or a representative from the companywho owns the SuperPass account (“Account Representative”), or an Eligible Driver, may submit a nomination form on behalf of an Eligible Driver with the latter’s prior authorization, throughthe online entry form. The online entry form must be fully completed with all of the required information, as indicated on the form itself at www.petro-pass.ca/hatsoff. If any requiredinformation is not included in the entry form, the entry will not be an eligible entry for the Contest and will be deemed null and void.
1.3 Contest Entry: Upon submission of the fully completed Contest entry form, Eligible Drivers will be given one (1) entry into the Contest.
1.4 Contest Entry Restrictions: There is a limit of one (1) eligible entry per Eligible Driver for the Contest. Each entry will be reviewed and deemed eligible or ineligible by Suncor inaccordance with these Rules. Incomplete, subsequent or ineligible entries will be considered void and not an eligible entry into the Contest.
1.5 Awarding of Prizes: Prizes will be awarded to the selected Eligible Driver whose contact information (name, phone number and email address) has been given at time of the enrolment inthe Contest via the online entry form and who have complied with all of the Rules.
2. Prize
2.1 Prizes: Six (6) prizes will be awarded. Each Prize is a $1,000 CAD Petro-Canada gift card (“Prize”) which can be used to purchase motor fuel or other items sold at Petro-Canadabranded retail sites.
A panel of judges (see Rules 2.3 and 2.4) will select the finalists from Eligible Drivers, who will then have a chance to win a Prize.
Each Prize must be accepted as awarded. No cash alternatives, substitution or transfers of the Prizes will be allowed. Without limiting the foregoing, Prize winners shall not be entitledto convert the Prize for the credit towards past purchases at Petro-Canada retail sites or into cash.
2.2 Odds: The odds of being selected to win a Prize depend on the total number of eligible entries received during the Contest Period and on the selection of Eligible Drivers by thepanel of judges (see Rules 2.3 and 2.4).
2.3 Judging: A panel of judges consisting of four (4) Suncor employees will select potentially winning entries based upon the character and reputation of Eligible Drivers nominated asdescribed in the nomination form, including, but not limited to, his/her record and deeds as a professional truck driver, safe and reliable driving record, community involvement, andenthusiasm for Petro-Pass. Suncor may contact Cardholders to validate and confirm any information provided on an Eligible Driver’s entry, and may disqualify any Eligible Driver should theinformation presented for an Eligible Driver be determined by Suncor (as through the panel of judges), acting reasonably, to be false or different than what Suncor determines to be thecorrect information following Suncor’s review and investigation. Judging will be completed by July 22, 2019.
Each judge will rank their top fifteen (15) Eligible Driver entries from all of the eligible entries received during the Contest Period. The top six (6) Eligible Drivers with the highestrankings from the judges will be the selected Eligible Drivers to be eligible to win a Prize, subject to Rule 2.4. Once an Eligible Driver has been determined by the panel of judges to beranked in the top six (6) entries from the Contest and the information in the Eligible Driver’s entry is determined to be correct, and the Eligible Driver has met all of the requirements ofthe Contest under the Rules, Suncor may award a Prize to each of the top six (6) Eligible Drivers and will then announce all Prize winners from the Contest at 5 pm on Wednesday, July 24,2019 at 2489 North Sheridan Way, Mississauga, ON.
Winners may be featured as part of future Petro-Pass marketing materials in 2019, as determined by Suncor. If, after being selected as a potential winner by the panel of judges, Suncordetermines that the information submitted in the entry of a selected Eligible Driver is incorrect or false, Suncor is entitled to remove the Eligible Driver’s entry into the Contest, andthe initially selected Eligible Driver will be disqualified, his/her right to the Prize will be forfeited, and such selected Eligible Driver will have no further recourse towards Sponsor oranyone involved in the Contest. The next Eligible Driver, as determined by the panel of judges, will be notified of such Eligible Driver being selected.
Each selected Eligible Driver will be contacted by email by a Suncor representative. At least three (3) attempts to contact the selected Eligible Driver by email will be made within thefourteen (14) days following the winner selection. If Suncor is unable to contact the selected Eligible Driver within fourteen (14) days following the judging, the next highest rankedEligible Driver, as determined by the Suncor judges, will be notified of such Eligible Driver being selected and the initially selected Eligible Driver will be disqualified, his/her rightto the Prize will be forfeited, and that selected Eligible Driver will have no further recourse towards Sponsor or anyone involved in the Contest.
There is a limit of one (1) prize per Eligible Driver for the Contest.
2.4 Prize Claim: In order to win a Prize, each selected Eligible Driver must first correctly answer a time limited, mathematical, skill-testing question to be administered by telephone,and then he or she will be required to sign and return a standard Declaration and Release form confirming compliance with the Rules, the eligibility requirements, acceptance of the Prize asawarded, and release the Sponsor from all liability. Subject to Rule 2.1, no substitution for, or transfer of Prizes, will be allowed. The selected Eligible Driver will have seven (7) daysto return the Declaration and Release form upon receipt.
If the selected Eligible Driver does not do so, the next Eligible Driver, as determined in the sole discretion of the panel of judges, will be notified of such Eligible Driver beingselected and the initially selected Eligible Driver will be disqualified, his/her right to the Prize will be forfeited and that selected Eligible Driver will have no further recoursetowards Sponsor or anyone involved in the Contest.
3. General rules
3.1 All Prize claims are subject to verification by Sponsor and/or its designated representatives. Entries made with multiple addresses, under multiple identities, through the use of anydevice or artifice to enter multiple times or entries that are in excess of the permitted number of entries for the Contest are automatically void. Sponsor will be the sole and finalreference source in validating Prize claims. Sponsor is not responsible or liable for late, lost, incomplete, illegible, misdirected, stolen, delayed, damaged or destroyed entries,notifications, replies or any Declaration and Release Form; for lost, interrupted, inaccessible or unavailable networks, servers, websites or other connection, related to the Contest forerrors of any kind, including but not limited to human, electronic, mechanical and/or technical in nature; for failure or technical malfunction of any telephone network or lines, computerand online systems, servers, computer equipment, software, e-mail, players, or browsers on account of technical problems or traffic congestion on the Internet, any related website,application or any combination thereof or otherwise; for any injury or damage to entrant, entrant's computer, or any other person's computer related to or resulting from participating in ordownloading material in connection with the Contest; or for incorrect or inaccurate information.
3.2 By participating, each Eligible Driver and the winner agrees:
a. to be bound by these Rules, and the decisions of Sponsor,
b. to the collection and use of his/her personal information by Sponsor for the purpose of administering the Contest,
c. to release and hold harmless Sponsor, their affiliates, subsidiaries, and independent contractors, and their respective directors, officers, employees, agents and representativesincluding advertising and promotion agencies, from any and all liability for any claims/damages whatsoever with respect to acceptance, possession or use or misuse of the Prize orparticipation in the Contest,
d. to permit Sponsor to use his/her name, city, province/territory of residence, photograph, likeness, video, voice and/or declarations regarding the Prize for Petro-Pass marketingmaterial, as determined by Sponsor, without any compensation, and
e. to sign a Declaration and Release Form to this effect. The decisions of Sponsor in relation to this Contest will be final and binding on all Contest entrants.
3.3 Subject to what is otherwise provided in these Rules, Suncor reserves the right to cancel, terminate, or suspend this Contest, at their sole discretion, in the event of a technicalfailure, computer virus or bug, unauthorized human intervention, fraud or any other occurrence or cause beyond their control that corrupts or adversely affects the administration, security,fairness or normal operation of the Contest.
3.4 If a selected Eligible Driver is awarded a Prize due to a system error, malfunction or defect or human error, the Prize will be returned to the Prize pool to be re-awarded.
3.5 Under no circumstances will Suncor, and each of its affiliates, subsidiaries, and independent contractors, and their respective directors, officers, employees, and agents, includingadvertising and promotion agencies be required to award more prize(s) than indicated in these Rules or award the Prize other than in accordance with these Rules.
3.6 The Contest is subject to all federal, provincial and local laws, as well as the rules adopted in view of said laws. All issues and questions concerning the construction, validityinterpretation and enforceability of the Rules or the rights and obligations as between the entrant and Suncor in connection with the Contest shall be governed by and construed inaccordance with the laws of the province of Ontario without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any otherjurisdiction’s laws.
For residents of Quebec only, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for aruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
