OFFICIAL RULES

NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN.

1. SPONSOR: NHL Awards™ Contest presented by BioSteel (the “Contest”) is sponsored by BioSteel, 87 Wingold Ave, North York, ON M6B 1P8 (the “Sponsor”).

2. ELIGIBILITY: The Contest is open to legal residents of Canada who are eighteen (18) years of age or older at the time of entry, with the exception of employees, officers, directors, agents and representatives of the Sponsor, the National Hockey League (“NHL”), its member clubs, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., NHL Interactive CyberEnterprises, LLC (the foregoing NHL entities collectively, the “NHL Entities”), each of their respective parent, related and affiliated companies, subsidiaries, departments or agencies, franchisees, suppliers, advertising and promotional agencies, contest administrators, and any other parties engaged in the development, production or distribution of Contest materials and those living in the same household.  By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules.  Entrants who do not comply with any of the Contest Rules are subject to disqualification by the Sponsor, in the Sponsor’s sole discretion.

3. CONTEST DATES AND TIMES: The Contest begins on March 14, 2023 at 12:00:00 am Eastern Time (ET) and ends on May 22, 2023 at 11:59:59 pm ET (the “Contest Period”), after which time the Contest will be closed and no further entries shall be accepted.

4. AGREEMENT TO BE LEGALLY BOUND BY RULES: By participating in this Contest, you are signifying your agreement that you have read and agree to be legally bound by these Official Rules and Regulations (the “Rules”).

5. HOW TO ENTER:  Purchase any two (2) BioSteel 500ml Ready To Drink Tetra Packs at participating Petro Canada locations and present your Petro-Points card or pay with a RBC debit or credit card that has been linked to a Petro-Points card at the time of the purchase transaction during the Contest Period at participating Petro stores across Canada to be automatically entered or, without purchase, by going to https://biosteel.ca/pages/petro-canada-nhl-awards and completing all necessary fields on the entry form as directed. By presenting your Petro-Points card or RBC debit or credit card in the manner described above, or by successfully transmitting a completed entry form as directed during the Contest Period, you will receive one (1) entry in the Contest. One entry per 24-hour period per person regardless of method used.  No limit of total entries during the Contest Period as long as a 24-hour window is respected.

Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple accounts, identities, or registrations, all in the Sponsor’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize.  Entries that contain false or incomplete information are void.  Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of the Contest Rules are void.  Entrants grant Sponsor a non-exclusive license to use all entries for any purpose.  No correspondence will be entered into except with selected entrants.  Proof of transmission (screenshots or captures, etc.) does not constitute proof of entry or receipt of an entry.

6. CONTEST PRIZES: There is a total of ONE (1) prize (approximate retail value outlined in Schedule A) (the “Prize”). ONE (1) winner will receive the Prize listed in Schedule A. The winner assumes any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this promotion or use or redemption of a Prize.  Prize must be accepted as awarded and has no cash value.  Prize or any portion thereof cannot be combined with other discounts, promotions or special offers.  Sponsor reserves the right to substitute an alternate prize of equal or greater value if an advertised Prize is unavailable at time of award. The Contest Prize is not transferrable.

The Prize consists of the opportunity for the confirmed winner and one (1) guest (subject to Guest Requirements noted below – the “Guest”) to travel to the city hosting the 2023 NHL Awards™  (“Host City”). The Prize includes (i) roundtrip airfare (economy class) for the confirmed winner and his/her Guest to the Host City from a Canadian airport near the confirmed winner’s residence (as determined by Sponsor in its sole and absolute discretion) in the form of airfare gift card or voucher; (ii) accommodation for the confirmed winner and his/her Guest (double occupancy) for two (2) nights in a hotel or hotels determined by Sponsor in its sole and absolute discretion in the form of hotel vouchers; (iii) $1,000 CAD spending money for the confirmed winner in the form of two (2) MasterCard gift cards; (iv) two (2) general admission tickets to attend the NHL Awards™ .  As between Sponsor and the Contest winner, arena seating type and location will be determined by the Sponsor in its sole and absolute discretion.

The Prize has a total approximate maximum retail value of $6,500 CAD– although the actual retail value will vary depending on the point of departure. Under no circumstances whatsoever will any difference between the actual and approximate retail values be awarded. Choice of flights, airline(s), hotel accommodations (including, without limitation, room size and occupancy) and all other aspects of the Prize are at the sole and absolute discretion of the Sponsor.

Without limiting the generality of the foregoing, the following general conditions apply to the Prize: (i) Prize must be accepted as awarded and is not transferable, assignable and/or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions are permitted, except at Sponsor’s option; (iii) all travel related to the Prize must occur within and/or on or before the date or dates specified by the Sponsor (otherwise the Prize may, in the sole and absolute discretion of the Sponsor, be forfeited in its entirety and, if forfeited, nothing will be substituted in its place); (iv) the confirmed winner and his/her Guest must: (a) have all necessary documentation to permit travel (including, if required, international travel to the United States of America and re-entry to Canada); and (b) travel on the same itinerary as set by or on behalf of the Sponsor; (v) the costs of everything not specifically and expressly stated above as included in the Prize are the sole and absolute responsibility of the confirmed winner and his/her Guest, including, without limitation: meals and drinks; gratuities; entertainment; health and travel insurance; the cost and expense of any required COVID-19 testing; transportation for confirmed winner and his/her Guest to and from the Canadian departure airport selected by the Sponsor; additional transportation; baggage and other fees; and items of a personal nature (NOTE: confirmed winner and/or his/her Guest may be required to present a valid major credit card in his/her name at the time of hotel check-in to cover any incidental expenses); (vi) if the confirmed winner and/or his/her Guest do not utilize any part(s) of the Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (vii) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (viii) all travel arrangements relating to the Prize must be made through the Sponsor or its designated agents; and (ix) by accepting the Prize, the confirmed winner agrees to waive all recourse against the Sponsor and all of the other Released Parties (as defined below) if the Prize or a component thereof does not prove satisfactory, either in whole or in part.

Guest Requirements : Each confirmed winner’s Guest must: (a) either be of the legal age of majority in his/her jurisdiction of residence or have the express written consent (in form and substance satisfactory to the Sponsor, in its sole and absolute discretion) to accompany the confirmed winner on the Prize trip; and (b) sign (and have his/her parent/legal guardian if he/she is under the legal age of majority in his/her jurisdiction of residence) and return the Sponsor’s release (by the date indicated on the release form) indicating (among other things) that he/she waives all recourse against the Sponsor and all of the other Released Parties (as defined below) relating to his/her participation in the Prize (including, without limitation, any travel related thereto). It is strongly recommended and encouraged that each confirmed winner and his/her Guest obtain sufficient personal travel and medical insurance prior to departure. Flights are subject to availability, blackout periods, government restrictions and regulations, airline, airport or other transportation restrictions and regulations. The Sponsor and other Released Parties are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason, of any aspect of a Prize – including, but not limited to flight(s) and/or the event. Neither a confirmed winner nor his/her Guest nor any other person or entity will be compensated in the event of such delay, cancellation or other event contemplated herein. The Sponsor will not replace any lost or stolen tickets. Changes to flights and/or passenger names are not accepted once bookings have been confirmed.

Winner and Guest must abide by all venue policies and event ticket terms and conditions including any rules and regulations related to COVID-19. Sponsor reserves the right to revoke the full or partial Prize from any winner or winner’s Guest who it or venue personnel deem, in their sole discretion, may be intoxicated, be a safety risk, have violated any venue policy or law, or may bring the Sponsor or the NHL Entities into disrepute.

7. ODDS OF WINNING: The odds of winning depend on the number of eligible entries received before the Contest End Date (as defined below in Schedule A).

8.  SKILL-TESTING QUESTION: Selected Entrants (as defined below) will be required, as a condition to winning a Prize, to correctly answer, without assistance of any kind, the Sponsor’s time-limited, mathematical skill-testing question to be administered via the Sponsor release.

9. WINNER SELECTION AND CONFIRMATION: Winner will be selected and confirmed as per Schedule A. The Sponsor, or an employee, agent or other representative of the Sponsor, will conduct a random draw from all eligible entries and select the potential winner (the “Selected Entrant”).  The Selected Entrant will be deemed a winner if they meet all of the eligibility criteria set out in these Contest Rules. If Selected Entrant does not meet the eligibility criteria, he/she will be disqualified and will not receive a Prize and another entrant will be selected by way of a random draw from the remaining eligible entries. Before being declared a winner, Selected Entrant will be required to: (i) correctly answer the Sponsor’s skill-testing question; (ii) sign and return the Sponsor’s Declaration of Eligibility and Liability/Publicity Release form; and (iii) comply with all other Contest Rules, all in the sole discretion of Sponsor.

The Selected Entrant will be notified within five (5) business days of the draw and will be contacted via the email address provided at the time of entry into the Contest, in Sponsor’s sole discretion, and up to two (2) attempts will be made within forty-eight (48) hours following the first notification.  If the Selected Entrant does not or cannot accept the Prize may be forfeited. The Sponsor’s release form must be signed by the Selected Entrant and received by the Sponsor as per the timelines detailed in Schedule A. Sponsor is not responsible for the failure for any reason whatsoever of a Selected Entrant to receive notification or for the Sponsor to receive a Selected Entrant’s response.

Disputes regarding identity of entrant: If the identity of a Selected Entrant is disputed, the entry will be deemed to have been submitted by the Authorized Account Holder (the individual assigned to the email address or, if applicable for entry, social media handle associated with the entry).  Each Selected Entrant may be required to provide proof that he/she is the Authorized Account Holder associated with the selected entry.

10. RELEASE AND INDEMNIFICATION: The winner must sign the Sponsor’s Declaration of Eligibility and Liability/Publicity Release form to: (i) confirm compliance with the Contest Rules; (ii) agree to accept the Prize as awarded; (iii) release, discharge and hold harmless the Sponsor, Suncor Energy Inc., their respective agents,  the NHL Entities, each of their respective departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, , and all others associated with the administration, development and execution of the Contest (the “Released Parties”) from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a Prize or any travel related thereto, and the use of the entry by the Sponsor, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner with any aspect of the Contest or any Prize, liability for physical injury, death, or property damage which the entrant, Guest, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of the entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of the Prize as awarded; and (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by an entrant with any of the Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a Prize and the use of the entry by Sponsor.

The Sponsor is not responsible for: (i) incorrect or inaccurate entry information which may affect a person’s ability to participate in the Contest or be awarded a Prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries which fail to fully comply with these Contest Rules; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) lost, incomplete, delayed, mutilated or misdirected entries or Declaration and Release forms; (iv) injury or damage to the entrant’s computer or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding the Contest or accepting a Prize; (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any Prize, including any travel related thereto and the use of the entry by Sponsor; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer “hackers” or otherwise; or (vii) late, lost, misdirected or unsuccessful efforts to notify a potential winner.

11. OTHER CONDITIONS: 

The Sponsor reserves the right to terminate or amend this Contest at any time and in any way, without prior notice.  Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned for any reason, the Sponsor reserves the right to cancel the Contest and conduct a random draw from all previously-received eligible entries received by the Contest End Date.

Publicity and entrant information: By participating in the Contest, entrants consent to the use of their name, address, postal code, social media handles, comments and image, whether on videotape, photograph or any other means, for the administration of this Contest or any publicity carried out by the Sponsor, without further notice or compensation.

Law: The Contest is void where prohibited by law and is subject to all applicable Canadian federal, provincial, territorial, municipal and local laws. This Contest shall be governed exclusively by the laws of Ontario, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest Rules, rights and obligations between entrants and the Sponsor, and procedural provisions, without giving effect to any choice of law or conflict of law rules.  Any dispute shall be adjudicated by the courts sitting in Ottawa, Ontario.

Intellectual Property: All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by the Sponsor.  All rights are reserved.  Unauthorized copying or use of any copyrighted material or other intellectual property without the express written consent of the Sponsor is strictly prohibited.  The Sponsor’s marketing or other partners, if any, shall also have access to and rights to reproduce, copy or otherwise use any materials generated by this Contest or any submissions or materials generated by entrants.

Entrants residing in QC only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling.  Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

12. PRIZE CONDITIONS

Prize must be accepted as awarded and is not transferable or assignable (except as may be specifically permitted by Sponsor in its sole and absolute discretion). No substitutions are permitted, except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute any Prize or a component thereof with a prize of equal or greater retail value. The Sponsor and the other Released Parties make no representation and do not offer any warranty, express or implied, as to the quality or fitness of any Prize awarded in connection with the Contest. To the fullest extent permitted by applicable law, each confirmed winner understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor or any of the other Released Parties should his/her Prize fail to be fit for its purpose or is in any way unsatisfactory. For greater certainty and the avoidance of any doubt, by accepting a Prize the confirmed winner agrees to waive all recourse against the Sponsor and all of the other Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part.
