Petro-Points 25th Birthday Contest
December 1, 2020 – February 8, 2021 (the “Contest Period”)
RULES AND REGULATIONS
No Purchase Necessary to enter for a chance to win
1. HOW TO PARTICIPATE
1.1 Sponsor: The sponsor of this contest is Suncor Energy Products Partnership (the “Contest Sponsor”).
1.2 Eligibility: The Petro-Points 25th Birthday Contest (“Contest”) is open to residents of Canada only who:
1.2.1 have reached the age of majority in their province/territory of residence;
1.2.2 are in full compliance with these Contest Rules and Regulations (“Rules”); and
1.2.3 are registered members of, and in good standing with, the Petro-Points program with an online Petro-Points account.
Each entrant meeting all of the above criteria will be referred to as “Eligible Entrant”.
The following individuals are not eligible to participate in the Contest:
1.2.4 employees and retirees of Contest Sponsor and its parent, subsidiaries, affiliates, franchisees, agents, associates, dealers, representatives, advertising and promotional agencies;
1.2.5 members of the immediate family (brothers, sisters, children, father, mother, spouse) of the individuals outlined in 1.2.4 and
1.2.6 any person living with the individuals outlined in 1.2.4 and 1.2.5.
1.3 Contest Period and Entry:
No Purchase Necessary: No purchase is necessary to win a Prize.
Prize Entry by Online Submission: Eligible Entrants will receive one (1) Contest entry by submitting an original, distinctly-worded story or memory about how they celebrated a birthday that is between 25 and 500 characters long via the online submission form on the Contest Sponsor’s website at www.petro-points.com/25years (“Online Submission”). No more than one (1) Contest entry may be obtained each week (Monday-Sunday) of the Contest Period.
Prize Entry by Mail-in Story Submission: Eligible Entrants may also receive one (1) Contest entry (“Mail-In Submission”) by sending by mail a hand-written, original (not mechanically reproduced), distinctly worded, story or memory 25-500 characters in length about how they celebrated a birthday, which must include the Eligible Entrant’s Petro-Points number, to: Petro-Points 25th Birthday Contest, 20440 Simcoe Street, Seagrave, Ontario, L0C 1G0. Submissions must be postmarked during the Contest Period and must be received no later than February 16, 2021. Limit of one (1) Submission per envelope with sufficient postage. All Mail-In Submissions will bear the same odds of winning a Prize as Online Submissions. Online Submissions and Mail-In Submissions are collectively referred to herein as “Submissions”.
1.4 Contest Entry Restrictions: Equivalent of a maximum of one (1) Contest entry per qualifying Submission. Maximum of ten (10) Contest entries per Eligible Entrant during the Contest Period.
1.5 Ineligible Stories: Contest Sponsor reserves the right to reject any Submission which, in Contest Sponsor’s sole and absolute discretion:
1.5.1 is less than one complete sentence in length or otherwise fails to meet the character or word length requirements set out on the Contest Sponsor’s website or in these Rules, as applicable;
1.5.2 is submitted in a language other than English or French;
1.5.3 contains inappropriate or foul language (including, without limitation any derogatory, harmful, obscene, sexually explicit, indecent, lewd, violent, abusive, profane, insulting, threatening, harassing, discriminatory, defamatory, hateful or otherwise objectionable language);
1.5.4 describes any unauthorized use of the Petro-Points Program or breach of the terms and conditions thereof;
1.5.5 is patently false or deceptive;
1.5.6 contains any personal contact information or other personal information identifying any third party;
1.5.7 was submitted using any robot, spider, offline reader, site search/retrieval application or other manual or automatic device, tool, or process to in any way circumvent the navigational structure or presentation of the Contest Sponsor’s website or its contents, including with respect to any CAPTCHA displayed on such website; or
1.5.8 is plagiarized or duplicative of a Submission previously received.
1.6 Awarding of Prize: Subject to the Rules of the Contest, each Contest Prize will be awarded to the Eligible Entrant whose name and address appears on Contest Sponsor’s Petro-Points database for the Petro-Points account associated with the potentially winning Submission. In the event of a discrepancy or dispute as to the identity of the Eligible Entrant associated with the winning Petro-Points account, Contest Sponsor’s determination of the identity of such Eligible Entrant shall be final and binding.
1.7 Submissions Property of Contest Sponsor: By making a Submission, the entrant agrees that such Submission will become the property of Contest Sponsor. Contest Sponsor shall have the unqualified right to the content of any such Submission for any purpose in Contest Sponsor’s sole and absolute discretion. To the extent an entrant has any moral rights in or to the content of any Submission, such entrant hereby waives such moral rights in favour of the Contest Sponsor.
2. PRIZES
2.1 Prizes: Two hundred and fifty (250) prizes of one (1) million Petro-Points (each, a “Prize”) are available to be won during the Contest . The approximate value of each Prize is $1,000. The Prize must be accepted as awarded. The Prize winner shall not be entitled to convert the Prize for cash, and no alternatives, substitutions or transfers of the Prize will be allowed. No Eligible Entrant may be awarded more than one (1) Prize.
2.2 Timing: Each Prize will be awarded within four (4) to six (6) weeks of the Prize Draw.
2.3 Odds: The odds of being randomly selected for a Prize depend on the actual number of Submissions received during the Contest Period.
2.4 Prize Draw: A draw for each of the Prizes will be made by a random computer-generated selection which will take place on February 17, 2021 at 20440 Simcoe Street, Seagrave, ON, from all Submissions registered during the Contest Period (“Prize Draw”). The selected Eligible Entrants will be contacted by email or telephone by the Contest Sponsor or its representatives. If the Contest Sponsor is unable to obtain a personal response from a selected Eligible Entrant within ten (10) business days of the Prize Draw or if, within that same period, Contest Sponsor or its representatives are unable to proceed to administer the skill testing question under the procedure provided for in section 2.6 hereafter, then another Eligible Entrant will be randomly selected for that Prize and such initially selected Eligible Entrant will be disqualified, his/her right to the Prize will be forfeited and such initially selected Eligible Entrant will have no further recourse to Contest Sponsor, its affiliates, or agents or their respective directors, officers or employees.
2.5 Skill Testing Question: In order to win a Prize, the selected Eligible Entrant must correctly answer a time limited, arithmetical, skill-testing question to be administered by telephone by the Contest Sponsor or its representatives, and he or she will be required to sign and return a standard Declaration and Release form confirming: (i) compliance with the Rules (including, without limitation, compliance with the eligibility requirements listed in Section 1.2 of the Rules); (ii) the acceptance of a Prize as awarded; and (iii) the release of Contest Sponsor from all liability. The selected Eligible Entrant will have seven (7) days to return the Declaration and Release form from the date of receipt by registered mail or email requesting proof of delivery. If the selected Eligible Entrant fails to return the Declaration and Release form within such period, another entrant will be randomly selected for that Prize and such initially selected Eligible Entrant will be disqualified, his/her right to a Prize will be forfeited and such initially selected Eligible Entrant will have no further recourse to Contest Sponsor, its affiliates, or agents or their respective directors, officers or employees.
2.6 Unclaimed Contest Prize: In the event that a Prize remains unclaimed after the Contest Sponsor has made a reasonable effort (as outlined in Rules 2.4 and 2.5) to award such Prize, the Contest Sponsor reserves the right to abandon the process for awarding such Prize to the applicable Eligible Entrant and, in such a case, at its sole discretion, may instead cancel such Prize or donate the Prize to a charitable organization of its choosing.
3. GENERAL RULES
3.1 All Prize claims are subject to verification by Contest Sponsor and/or their designated representatives. Submissions made with multiple addresses, under multiple identities, through the use of any device or artifice to enter multiple times or Submissions that are in excess of the permitted number of Submissions for the Contest Period are automatically void. Contest Sponsor will be the sole and final arbiter for validating Prize claims.
3.2 If a dispute arises regarding who submitted a Submission, the Submission will be deemed to have been made by the primary Petro-Points member identified in the Contest Sponsor’s Petro-Points database at time of such Submission.
3.3 By participating, each Eligible Entrant and the winner agree:
3.3.1 to be bound by these Rules and the decisions of Contest Sponsor,
3.3.2 to the collection and use of his/her personal information by Contest Sponsor for the purposes set forth in these Rules or otherwise for the administration of the Contest,
3.3.3 to release and hold harmless Contest Sponsor, their affiliates, subsidiaries, partners, and independent contractors, and each of their respective directors, officers, employees, agents and representatives including advertising and promotion agencies, from any and all liability for any claims/damages whatsoever with respect to acceptance, possession, use or misuse of the Prize, and/or Submission or attempt to enter the Contest,
3.3.4 to permit Contest Sponsor to use his/her Submission, his/her name, photograph, video, the details on his/her Submission, city, province/territory of residence, their story about the prize and how they may use it, and/or declarations regarding the Prize for advertising or publicity purposes without any additional compensation, and
3.3.5 if they are selected as a potential winner, to execute and deliver a Declaration and Release Form in favour of the Contest Sponsor, and in a form reasonably acceptable to Contest Sponsor, as a condition of the awarding of a Prize.
3.4 The decisions of Contest Sponsor in relation to the Contest will be final and binding on all Contest entrants, unless otherwise provided in these Contest Rules.
3.5 Contest Sponsor shall not be responsible for incorrect or inaccurate transcription or registration of Contest entry information, technical malfunctions, lost / delayed / incomplete / interrupted / misdirected / stolen / illegible / deleted data / network transmissions, line failures of any telecommunication network, failure of computer equipment, software, websites, inability to access any online service or web site, inability to submit the online submission form or any other malfunction or human or technical error, or any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials related to the Contest, or for late, lost, stolen, postage due, illegible, undelivered or misdirected Submissions.
3.6 Contest Sponsor reserves the right to cancel, terminate, or suspend this Contest, with or without notice to Eligible Entrants and at its sole discretion, in the event of a technical failure, computer virus or bug, unauthorized human intervention, fraud or any other occurrence or cause beyond its control that corrupts or adversely affects the administration, security, fairness or normal operation of the Contest, subject, in Quebec, to the approval of the Régie des alcools, des courses et des jeux.
3.7 If a selected Eligible Entrant is awarded a Prize due to a system error, malfunction or defect or human error, the Prize will be returned to the Prize pool, to be re-awarded among Submissions eligible for the Prize Draw.
3.8 Under no circumstances will the Contest Sponsor be required to award more prizes than indicated in these Rules or to award a Prize otherwise than in accordance with these Rules.
3.9 The Contest is subject to all Federal, Provincial and local laws, as well as the rules adopted in view of said laws. For non-Quebec residents: All issues and questions concerning the construction, validity, interpretation and enforceability of the Rules or the rights and obligations as between the entrant and Contest Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the province of Ontario and the federal laws of Canada applicable therein without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. For Quebec residents: any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Quebec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

3.11 The invalidity or unenforceability of any term or provision of these Rules will not affect any other term or provision of these Rules; the remaining terms and provisions will continue in full force and effect. The invalidity or unenforceability of any term or provision of these Rules in any particular jurisdiction will not affect its validity or enforceability in any other jurisdiction where it is valid or enforceable.
3.12 In case of any discrepancy between the French and English versions of these Rules, the English version shall prevail.
